Cunoscutul petrolist roman si puternic om de afaceri dar si unul dintre cei mai mari adversari pe care Basescu i-a "identificat" ca fiind impotriva sa, a fost retinut de procurori pentru 24 de ore, intr-o maniera clara de intimidare si de "aratare a pisicii" de catre anchetatorii lui Basescu. Patriciu a fost declarat de catre Basescu dusmanul sau atat pentru ca ar fi unul dintre stalpii de baza ai PNL cat si pentru bunele sale relatii cu lideri marcanti ai PSD. Si, mai presus de toate, Patriciu a considerat ca desemnarea si alegerea ca presedinte a lui Basescu nu este benefica pentru Romania si, drept urmare, nici nu a contribuit financiar la campania prezidentiala a acestuia. Ceea ce Basescu nu a uitat si nu i-a iertat. In noaptea de 26-27 mai 2005, dupa audieri-maraton de 18 ore, ex-presedintele Rompetrol este retinut de procurori, pentru 24 de ore, in dosarul Petromidia. Procurorii cer mandat de arestare preventiva. Adus la tribunal noaptea, cu jumatate de ora inainte de inceperea sedintei de judecata, omul de afaceri a ramas in libertate dupa ce instanta a corectat abuzul procurorilor de la DIICOT si a respins emiterea mandatului de arestare. Cunoscutul om de afaceri era acuzat de evaziune fiscala, spalare de bani si inselaciune, in legatura cu privatizarea Petromidia dar si cu alte afaceri din domeniul petrolului, intr-un dosar care s-a dovedit a fi o insailare lipsita de orice fundamente legale, facuta din slugarnicia unor procurori fata de presedintele Traian Basescu si la "sugestia" acestuia.
Dupa acest episod, au existat voci care au afirmat ca Parchetul transforma instrumentarea dosarului Patriciu intr-un "circ" ce pune in pericol activitatea unei firme private care asigura aproape cinci la suta din PIB si aproape sapte la suta din veniturile bugetului de stat. Mai mult, dupa aproape doi ani, in mai 2007, Dinu Patriciu castiga daune morale in procesul pe care l-a intentat Serviciului Roman de Informatii pentru faptul ca, timp de doi ani, i-a interceptat si ascultat ilegal convorbirile telefonice. Aceste interceptari ilegale au fost folosite de procurorii DIICOT in dosarul insailat impotriva sa.
